PayPal Class Action Settlement: Frequently Asked Questions


Q: What is this email referring to?

A: The email you received relates to the settlement of a class action lawsuit. In March 2002, a class action lawsuit was filed against PayPal, Inc. in the United States District Court for the Northern District of California in San Jose, California. The lawsuit alleged that PayPal violated a federal statute, entitled the Electronic Fund Transfer Act ("EFTA"), 15 U.S.C. §§ 1693 et seq., including provisions requiring PayPal to supply customers with information about dispute resolution procedures and to follow certain procedures when investigating complaints of unauthorized or incorrect electronic fund transfers.

PayPal does not acknowledge that any of the allegations in the case are true, and entered into the Settlement Agreement to avoid further costs of litigation, and to devote resources to more productive areas of our business.

In November, 2003, the parties to the action reached a Settlement, and, in or about July of 2004, you were sent an email "Notice" about the settlement. According to the records of the Claims Administrator, you sent in a claim for monetary relief after you received the “Notice” and prior to October 23, 2004, when the time to make a claim expired.

Q: How do I withdraw my money from my PayPal account?

A: There are several options to withdraw funds from your PayPal account.

If you have a bank account linked to your PayPal account, then it is easy to withdraw the funds directly to your bank account by clicking on the "Withdraw" tab from the "My Account" page.

If you do not have a bank account linked to your PayPal account, then it is easy to add it by clicking on the "Profile" tab from the "My Account" page.

You may also withdraw funds via the PayPal Debit Card or via check. For further information, you can go to the PayPal website and click on the "Help" link in the upper right corner of any page and then click on "Withdrawing Funds" from the category list.

Q: I can’t remember my PayPal Password. What do I do?

A: If you have forgotten your password, please go to the PayPal website and click on the "Forgot your password?" link in the log-in box and follow the directions. If you are having trouble, you may find further assistance by clicking on the "Help" link in the upper right corner of any page.

Q: Why did I receive a Class Action settlement payment?

A: If you received a settlement payment from the Claims Administrator, then, according to the records of the Claims Administrator, you sent in a claim form for monetary relief sometime prior to October 23, 2004

Q: Is it too late to change my claim or file a new one?

A: In accordance with the Notice of Pendency and the Court's orders, the period to file an online claim for the In Re PayPal Litigation Settlement ended on October 23, 2004 at midnight. No claims can be filed or changed after that date.

Q: Will I be getting another payment from PayPal?

A: Under the terms of the settlement agreement and the plan of allocation, class members are only entitled to one payment for their participation in the class.

Q: Why haven’t I received a settlement payment from PayPal?

A: PayPal is working with the Claims Administrator to send payments to all class members that filed valid claims under the settlement agreement. However, not all claims are being paid at the same time. You should check the claims administrator’s website for updates on the timing of class payments. You can access the administrator’s site by clicking here: https://www.paypal.com/settlement/
