Introduction
PayPal Giving Fund is operated for the benefit of the nonprofit sector (“PayPal Giving Fund,” “we” or “our”), and is a 501( c )(3) nonprofit organization. PayPal Giving Fund operates a website located at http://www.paypalgivingfund.org (the “Site”), which enables users of PayPal.com, eBay.com, and other websites or services with which we partner to donate to nonprofit organizations. This Privacy Policy describes your privacy rights regarding our collection, use, storage, sharing and protection of your personal information, which consists of personally identifiable information associated with an authorized user, including but not limited to name, address, email address, a credit card number and expiration date, and/or a PayPal account identifier (“Personal Information”). It applies to the PayPal Giving Fund website and all related sites, applications, services and tools regardless of how you access or use them.
Scope and Consent
You accept this Privacy Policy (“Privacy Policy”) when you sign up for, access, or use our products, services, content, features, technologies or functions offered on our website and all related sites, applications, services, and tools (collectively “PayPal Giving Fund Services” or “Services”). We may amend this Privacy Policy at any time by posting a revised version on our website. The revised version will be effective at the time we post it and in no event later than 7 days from the date of posting. Your continued use of the PayPal Giving Fund Services following posting of amendments will be considered express consent to all amendments to this Privacy Policy.
In order to make donations or be listed as a Participating Nonprofit, donors and nonprofits must agree to this Privacy Policy, the PayPal Giving Fund User Agreement, and the applicable terms and conditions of PayPal, eBay, or other third party website or service as appropriate (collectively, the “Terms and Conditions”). Participating Nonprofits must complete the PayPal Confirmed Charity process available on PayPal.com. Persons and organizations with permission to use the Site are considered “Authorized Users.” You may view portions of the Site even if you are not an Authorized User. This Privacy Policy applies to PayPal Giving Fund’s collection, use and disclosure of personal information from Authorized Users, as well as from persons who merely visit the Site, and this Privacy Policy is expressly incorporated in the Terms and Conditions. PayPal Giving Fund has adopted and implemented this Privacy Policy as part of our commitment to protecting your personal information.
What information do we collect?
PayPal Giving Fund collects the following types of personal information in order to provide you with the use of and access to the PayPal Giving Fund Services, and to personalize and improve your experience. PayPal Giving Fund collects information both automatically and from you when you access our Site and any of the PayPal Giving Fund Services.
Information collected automatically: PayPal Giving Fund may collect information from your computer, mobile phone, or other access device. This information may include, but is not limited to, data about the pages you access, computer IP address, device ID or unique identifier, device type, geo-location information, computer and connection information, mobile network information, statistics on page views, traffic to and from the sites, referral URL, ad data, and standard web log data and other information. We collect additional information through the PayPal Giving Fund Services that is not associated with your online account or your registration information, and that cannot be used to personally identify you (all such information is “Non-Personal Data”). Non-Personal Data ordinarily includes aggregate, summary, de-identified or other anonymous data, and may include, by way of example, statistics regarding total registrations, total amount of donations, popularity of particular pages within the Site, or information regarding types of Internet browsers used by Authorized Users. We also collect anonymous information through our use of cookies.
“Cookies” are small files placed on a user’s computer by a Web site in order to facilitate use of that Web site. For example, a cookie may contain information about a user’s preferences, so that the Web site automatically complies with those preferences whenever the user visits that Web site. When using the Site and Services, we may create “cookies” on your computer for purposes of facilitating and maintaining your current user session, and may collect Personal Information using those cookies in order to enable PayPal Giving Fund, PayPal, and eBay to identify you in connection with the Site and to track use of the Services for purposes consistent with this policy. You are free to decline our Cookies if your browser or browser add-on permits, unless our Cookies are required to help prevent fraud or help ensure the security of websites we control. However, declining our Cookies may interfere with your use of the Site and PayPal Giving Fund Services.
Do Not Track: Do Not Track (DNT) is an optional browser setting that allows you to express your preferences regarding tracking by advertisers and other third-parties. We do not currently respond to DNT signals. We do, however, provide you notice of the tracking by advertisers and other third parties in our privacy and cookies policies.
Information you provide to us: We may collect and store any information you provide to us when you access the PayPal Giving Fund Services, including but not limited to during the registration process, when processing donation payments, or as otherwise required to access or use the PayPal Giving Fund Services. In addition, PayPal Giving Fund collects certain Non-Personal Data.
PayPal Giving Fund collects and maintains a record of all data provided through any of the above-mentioned channels. In the course of making or receiving donations, Authorized Users may be required to provide certain contact information and financial information, such as name, address, email address, a credit card number, an expiration date, and/or a PayPal account identifier.
We also collect and maintain records of information that you voluntarily provide to us. For example, we may ask you to participate in a survey of Authorized Users, and may ask you to provide personally identifiable information, such as age, gender or other demographic data. However, unless such information is necessary for operating the Site and/or Services or required by the Terms and Conditions, we do not require you to provide such information to us. By providing such information voluntarily, you give PayPal Giving Fund permission to use such information as described in this Privacy Policy.
Information from other sources: PayPal Giving Fund may also receive information about you from other sources, including PayPal. This information may include, but is not limited to, Authorized Users’ PayPal account number, eBay Seller ID, and email address. These data are used to collect and maintain records of all individual transactions conducted through the PayPal Giving Fund Services. Those records are associated with each Authorized User’s individual account profile within the PayPal Giving Fund system. Please note that Authorized User’s PayPal and eBay passwords will never be shared with PayPal Giving Fund.
The PayPal Giving Fund Services are not directed to children and children are not eligible to use the PayPal Giving Fund Services. Protecting the privacy of children is very important to us. We do not collect or maintain personal information from people we actually know are under 18, and no part of the PayPal Giving Fund Services are designed to attract people under 18. If we later learn that a user is under 18, we will take steps to remove that user’s Personal Information from our databases and to prevent the user from utilizing the PayPal Giving Fund Services.
Use and disclosure of collected information
PayPal Giving Fund uses information collected from the PayPal Giving Fund Services in several ways, as outlined in this Privacy Policy. For example, we use Personal Information as needed to process donations made by Authorized Users, and to communicate with such Authorized Users. We also use both Personal Information and Non-Personal Data when evaluating ways to improve the PayPal Giving Fund Services. As further described below, we may disclose collected information, including Personal Information, to certain third parties in connection with collecting or processing donations, or as required by law. We will not use or disclose collected information in ways different from what is described in this Privacy Policy unless otherwise required by law.
PayPal Giving Fund uses information that we collect from you in order to provide donation services as described in the PayPal Giving Fund User Agreement or as required by law (“Necessary Disclosures”). For example, we use such information to do the following:
As a necessary part of providing the PayPal Giving Fund Services and processing donations, we may disclose information collected from you as described in this Privacy Policy. For example, we will disclose certain Personal Information collected from you through the PayPal Giving Fund Services to PayPal, eBay, other websites and services with which we partner, and to our registered nonprofit organizations. We may also provide Personal Information about you to our third party service providers for the purpose of receiving and processing payments. These third parties are prohibited from using your personal information for any other purpose than what is disclosed in this Privacy Policy and the Terms and Conditions. When you use the PayPal Giving Fund Services to choose a Participating Nonprofit to be the intended beneficiary of a donation, we may also disclose your name and contact information to the nonprofit organization that you have designated. Under certain limited circumstances, we may be subject to legal requirements to disclose information collected through the PayPal Giving Fund Services, and our policy is to comply fully with all such legal requirements. The disclosures contemplated by this paragraph are necessary if you wish to use the PayPal Giving Fund Services. As mentioned below, PayPal Giving Fund may use and disclose Non-Personal Data without restriction. If you do not want us to make such Necessary Disclosures, or to use Non-Personal Data without restriction, you must not use the Services.
PayPal Giving Fund also uses information collected through the PayPal Giving Fund Services to communicate with the Authorized Users from whom such information was collected in order to provide promotional materials about PayPal Giving Fund, about nonprofit organizations participating in the Services, and/or about our partners and affiliates. “Optional Communications” are all communications to Authorized Users that are optional, including but not limited to promotional materials about PayPal Giving Fund, about nonprofit organizations participating in the Service, and/or about our partners and affiliates. PayPal Giving Fund will refrain from sending Optional Communications to you if you inform us that you prefer not to receive them, as described in more detail below.
If we collect information that you provide to us voluntarily by participating in online surveys, through email communications, or by other means, we will treat that information as described above, as applied to both Personal Information and Non-Personal Data.
PayPal Giving Fund uses Non-Personal Data in a variety of ways, including but not limited to, evaluating the performance of the Site and the general preferences of Authorized Users, or to generate anonymous statistics for the benefit of nonprofit organizations participating in the Site or for our partners. Because Non-Personal Data is entirely anonymous, and therefore can never be used by us to identify you, this Privacy Policy does not limit PayPal Giving Fund’s ability to use or disclose Non-Personal Data.
PayPal Giving Fund will respect your preferences regarding whether it is permissible for us to make disclosures of Personal Information, as you may indicate to us in your “Account Profile,” which is the area of the PayPal Giving Fund site where your registration information and other information that you voluntarily provide is contained, as well as the area where you can set your preferences regarding Optional Communications and Optional Disclosures. If you indicate in your Account Profile that we may make such disclosures, third parties may contact you for various reasons, such as for purposes of providing promotional information about charitable opportunities. Unlike Necessary Disclosures, these kinds of disclosures of Personal Information are optional (“Optional Disclosures”), and Authorized Users may use the PayPal Giving Fund Services even if they indicate their preference that we not make such Optional Disclosures. PayPal Giving Fund will not make Optional Disclosures of your Personal Information if you inform us of that preference as described below.
We will not sell, trade or rent your personal information to any third party for promotional or unknown uses.
Choice, opting-in to Optional Communications and Optional Disclosures
Because PayPal Giving Fund respects your privacy, we provide certain opportunities for you to indicate your preferences regarding how we use and/or disclose information collected about you from the PayPal Giving Fund Services. If you are an Authorized User, you will be able to inform us whether you wish to receive certain Optional Communications from us and our select partners by indicating your preferences in your online account profile for the PayPal Giving Fund Services, which includes your registration information and other information voluntarily provided by you (your “Account Profile”). Each Authorized User may also indicate such preferences during the initial registration process, or may click here to contact us. Please also note that, although we will respect preferences that you indicate regarding Optional Communications and Optional Disclosures, information is nevertheless collected from your use of the PayPal Giving Fund Services as described above. We will treat Personal Information collected from you in accordance with your preferences, unless otherwise required by applicable law.
PayPal Giving Fund does not maintain responsibility for the manner in which third parties use or further disclose Personal Information collected from you through the Site after PayPal Giving Fund has disclosed that information to those third parties. However, we do require our third-party service providers to promise not to use such information except as necessary to provide the relevant services to us. If you do not want PayPal
Giving Fund to use or disclose Personal Information collected about you in the manners identified in this Privacy Policy as “Necessary Communications” and/or Necessary Disclosures, you must not use the PayPal Giving Fund Services. Necessary Communications are any and all communications that are necessary to provide the Services to Authorized Users. If you are merely a visitor to the Site but are not registered as an Authorized User, please note that PayPal Giving Fund does not collect any Personal Information except for information collected automatically in connection with the Site, so you do not need to opt-out regarding any such communications or disclosures.
The Site contains links to other websites. Please be aware that PayPal Giving Fund is not responsible for the privacy practices or the content of such other websites. PayPal Giving Fund encourages our users to be aware when they leave our Site and to read the privacy statements of each and every website that collects personally identifiable information. This Privacy Policy applies solely to information collected by PayPal Giving Fund through the Site and through all related sites, applications, services and tools.
Access to personal information collected from you
Authorized Users may access their Account Profile at any time to update Personal Information contained within that Account Profile. Subsequent uses or disclosures of information by PayPal Giving Fund will reflect those changes, but PayPal Giving Fund has no ability to update any information previously disclosed to any third party. Certain information within your Account Profile may be provided to PayPal Giving Fund by PayPal (such as nonprofit name, address and email address), and in such cases you will only be able to update such information by doing so within your PayPal account, after which the updates will be reflected within your Account Profile. Certain information, including email address, is necessary in order for PayPal Giving Fund to provide the PayPal Giving Fund Services; therefore, if you delete such necessary information you will not be able to use the Services.
Notwithstanding the foregoing, although most information within the Account Profile can be updated online, certain information within the Account Profiles of participating nonprofit organizations (e.g., payment account information) may only be changed by contacting PayPal Giving Fund directly or by following the instructions that PayPal Giving Fund may provide. For example, in order to change the payment account information of a participating nonprofit organization, PayPal Giving Fund will require that Participating Nonprofits confirm their charitable status with PayPal Confirmed Charities.
How we Protect and Store Personal Information Throughout this Privacy Policy, we refer to “personal information” to describe information that can be associated with a specific person and can be used to identify that person. We do not consider personal information to include Non-Personal Data. We store and process your personal information on our computers in the United States and elsewhere in the world where our facilities are located. We protect your information using physical, technical, and administrative security measures to reduce the risks of loss, misuse, unauthorized access, disclosure and alteration. Some of the safeguards we use are firewalls and data encryption, physical access controls to our data centers, and information access authorization controls.
Please be aware that, although we endeavor to provide reasonable security for information in our possession and control, no security system can prevent against all potential security breaches, and PayPal Giving Fund bears no liability for uses or disclosures of Personal Information or Non-Personal Data arising in connection with the theft thereof. Likewise, Authorized Users are responsible for safeguarding the confidentiality of passwords to the Services, and PayPal Giving Fund bears no liability for access to, or use or disclosure of, Personal Information, if such access, use or disclosure arises in connection with the theft or disclosure (whether intentional or negligent) of such Authorized User’s password.
