Shipping Center Terms and Conditions

These Shipping Center Terms and Conditions (“Terms”) govern your use of PayPal’s Shipping Center service (“Shipping Services”) available through your eligible PayPal account. In these Terms, we use the terms “PayPal” or “we” to refer to PayPal, Inc. In addition to these Terms, your use of Shipping Services is also subject to the PayPal User Agreement, the Acceptable Use Policy, the Privacy Statement and any other applicable agreements between you and PayPal. We may terminate, cancel, suspend, amend, or otherwise modify these Terms at any time consistent with the PayPal User Agreement, subject to applicable law.


1. OVERVIEW

The Shipping Services enable you to purchase third-party carriers’ shipping labels using your PayPal account. The Shipping Services are available to PayPal business and personal account-holders in good standing. You are responsible for all variable and transactional costs of using the service, including postage, fees for private carriers, package insurance, adjustments, and any applicable service fees and Taxes (as defined below). Third-party carrier rates may change at any time.

2. PAYMENT METHODS

In order to purchase shipping labels through the Shipping Services, you must select a payment method for each purchase. You can select any payment method linked to your PayPal account or use funds held as balance in your PayPal business account. You authorize us to charge the funding instrument(s) selected by you and any backup payment methods in connection with your use of the Shipping Services.

The billing entity for part or all of the services provided by PayPal may be that of a subsidiary, affiliate, or partner organization of PayPal and you hereby consent to any such billing, including changes to the billing entity from time to time.

3. INCORRECT SHIPPING DETAILS; COST ADJUSTMENTS

You are responsible for the accuracy of the information supplied by you about your shipments. For shipments where (a) you provide incorrect shipping details, or omit required shipping details, about your parcel (such as weight, address, dimensions, dimensional weight, service type, or package type), (b) shipment information is not legible, (c) the shipment has been tendered by you to the wrong carrier, or (d) the packaging is inadequate or improper, you acknowledge that the carrier may (i) deliver the parcel(s) at an increased rate that will be automatically charged to you, (ii) return the parcel(s) to you with the cost of the return and processing of the return charged to you, or (iii) destroy or dispose of the parcel(s), with the cost charged to you.

In the case of cost adjustments, if it is determined by PayPal or a carrier partner that a mailing or shipping transaction did not contain sufficient funds (e.g., not enough postage to cover a USPS shipment due to an underreporting of weight at time of print), PayPal may automatically deduct the amount for the unpaid or short-paid transaction from your designated payment method(s)or the payment method designated by you for such transaction or other payment methods associated with your PayPal account. At its sole discretion, PayPal may also include in such adjustments any surcharges, duties, and fees and Taxes determined by the carriers or the country shipped to (as applicable). You will be able to review these adjustments in your Shipping Services activity history and reports. If one or more of these payments cannot be collected from you (e.g., due to expired payment methods), your access to the Shipping Services or other PayPal services may be suspended.

4. CUSTOMS, DUTIES, AND OTHER CHARGES ON INTERNATIONAL SHIPPING

Duties and Taxes: Some carriers may offer expedited customs clearance which requires full payment of duties and taxes. The Shipping Services enable various ways to pay duties and taxes, including and not limited to: (i) duties and taxes are charged to your payment method; and (ii) duties and taxes are collected by the destination carrier from the recipient at the time of delivery. Improper classification of items in your parcel could result in adjustments to the amounts owned by you, an increase in the amount collected from the recipient, delay, disposal, or return. Note that due to international currency changes, the amounts may vary based on currency conversion at the time of your transaction. An additional administration fee related to the collection of duties and taxes may also apply. If your transaction requires the payment of duties and taxes by the recipient and your recipient refuses to pay for those amounts, you may be required to pay for the goods to be returned, destroyed, or disposed of, or for other amounts imposed.

Harmonized Tariff Schedule Codes for International Shipping: The Harmonized System Tariff code (“HS Tariff Code”) is used to classify physical goods and traded products for export to another country. PayPal urges you to provide the HS Tariff Code that corresponds to your shipment on the Customs Form. If you do not provide a HS Tariff Code on the Customs Form, the third-party carrier selected by you may assign one for you. If the carrier assigns a HS Tariff Code for your shipment, PayPal assumes no liability in connection with such shipment, including for fees, Taxes or penalties you are charged or any delays or the return of your package, due to the HS Tariff Code assigned.

5. POSTAL POSTAGE ACCOUNT REQUIREMENTS

Your ability to print USPS postage in the Shipping Services is facilitated by a third-party provider, Auctane, Inc. (d/b/a Stamps.com), an authorized PC Postage provider. By using the Shipping Services, you are also entering into an agreement with the United States Postal Service (USPS) in accordance with the Domestic Mail Manual (DMM) 604.4, Postage Payment Methods, Postage Meters and PC Postage Products (Postage Evidencing Systems or “PES”). You accept responsibility for control and use of your account and the PES printed therefrom.

You acknowledge that you have read the Domestic Mail Manual 604.4, Postage Payment Methods, Postage Meters and PC Postage Products (Postage Evidencing Systems) and agree to abide by all rules and regulations governing its use and all other applicable rules, regulations and instructions of the USPS. You represent and warrant to PayPal that you are using the Shipping Services as (i) an end-shipper to ship your own packages or enable return shipping of your products, or (ii) an asset-based third-party logistics provider to make shipping decisions and ship packages on behalf of your clients. Failure to comply with the rules and regulations contained in the DMM or any other applicable rules, regulations and instructions of the USPS or use of the PES in any fraudulent or unlawful scheme or enterprise may result in the revocation of this agreement. A written statement from the USPS that it no longer wishes to do business with you shall constitute sufficient evidence that you have not complied with USPS rules, regulations and instructions, and may lead to the suspension of your access to the Shipping Services.

Any use of the PES that fraudulently deprives the USPS of revenue can cause you to be subject to civil and criminal penalties applicable to fraud and/or false claims against the United States. The submission of a false, fictitious or fraudulent statement can result in imprisonment of up to five (5) years and fines of up to $10,000 (18 U.S.C. 1001). In addition, a civil penalty of up to $5,000 and an additional assessment of twice the amount falsely claimed may be imposed (3 U.S.C. 3802).

You understand that the rules and regulations regarding the PES may be updated from time to time by the USPS and it is your obligation to remain up to date and comply with current and future rules and regulations regarding use of the PES.


6. REFUNDS FOR UNUSED OR MISPRINTED TRANSACTIONS; DESTRUCTION OF UNUSED OR MISPRINTED TRANSACTIONS

In order to request a refund in connection with an unused shipping label, you must submit a request to us to void such shipping label, subject to the following rules and limitations, for any unused or misprinted items:

Acting on your behalf to request a refund. You agree that PayPal and its partners, to the extent required by any carrier service, is appointed to act on your behalf to request and obtain refunds. Refund requests are also subject to the rules and requirements of third-party carrier services, including USPS. PayPal makes no guarantee of the success of any refund request.

USPS Postage. Unused and/or misprinted USPS mailing and shipping labels or postage shall be defined as an envelope, label, plain paper, label stock containing carrier-compliant labels, or electronic image files, with full, intact indicium which is scan-able and unused. Postage handled and/or returned to sender shall not be considered valid unused and/or misprinted postage.

Carrier Labels. Unused and/or misprinted pre-paid carrier shipping labels shall be defined as an envelope, label, plain paper containing carrier-compliant labels, or electronic image files, with full, intact indicium which is scan-able and unused. Labels handled and/or returned to sender shall not be considered a valid unused and/or misprinted label.

Time Limit. You must complete the refund request within the time limit required by each carrier. Please see each carrier’s terms and conditions on their website for additional information. For USPS and DHL Pre-paid labels, you must generally complete the refund request within thirty (30) days of generating the mailing or shipping label.

Refund Process. Please visit the PayPal Shipping Center to submit your refund request. You must follow the listed steps and provide the required information to initiate and complete your refund request, including the return or destruction, if required, of the printed or misprinted but unused mailing and shipping labels. Incomplete requests will not be processed.

Rejections. You assume the risk of the applicable carrier partner improperly rejecting a refund request. PayPal will not refund the transaction unless the relevant carrier partner approves the refund.

Reimbursement. If the applicable carrier approves your refund, PayPal will credit your account for the full value of the transaction to be refunded, as approved by the carrier. Refund processing times may vary. If you have an outstanding balance (including for unpaid service fees), you may not receive any reimbursement credit until your account is brought current. PayPal may, in its discretion, deduct any outstanding balance from any refund otherwise due.

Destruction of Unused or Misprinted USPS Postage. USPS misprinted or unused labels must be destroyed or returned to the USPS, as provided in the Domestic Mail Manual (see Section 5), regardless of whether a refund is requested.

7. CARRIER AND PARTNER TERMS

Your use of carrier or partner services is as a direct customer of the specific carrier or partner of your choosing. You agree to be bound by the terms and conditions of each carrier and partner accessed through the Shipping Services, including terms governing the payment of fees and the carrier’s right to open, inspect and assess your package before and after collection. You must accept such terms and conditions prior to using such carrier’s or partner’s services. Please visit each individual website to obtain and review their terms and conditions and privacy policies. Carriers and partners may change their terms and conditions at any time. You authorize PayPal to establish an account for you on your behalf with each third-party carrier whose services you access through the Shipping Services.

Use of carrier and partner services made available to you through the Shipping Services is at your own risk. PayPal is not responsible for your use of these third-party services, and PayPal assumes no liability or responsibility whatsoever for third-party carriers’ services, including the failure of delivery.

Carrier rates may vary. They are dependent on the service you choose, the weight and dimensions of your parcel, and a variety of other factors. Carrier rates may also fluctuate. You agree to the rate displayed at the time of your transaction.

8. INDEMNIFICATION

In addition to your indemnification obligations under the PayPal User Agreement, you agree to defend, indemnify, and hold PayPal harmless from all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) resulting from (a) your shipment containing ineligible, restricted, illegal, or otherwise prohibited items; (b) your use of third-party carrier and partner services made available to you through the Shipping Services; or (c) your violation of any term of these Terms, the rules and regulations contained in the DMM or the terms and conditions of third-party carrier and partner services made available to you through the Shipping Services.

9. MISCELLANEOUS

  1. Account Access. All Shipping Services transactions originating from your account are your responsibility. Please be mindful of whom is given access to the account, as the account holder is responsible for all charges incurred. PayPal reserves the right to terminate your access to the Shipping Service, including for lack of payment or breach of these Terms.
  2. Authority. By using the Shipping Services, you agree to pay all fees incurred on your account. If your PayPal account was established for a business or other entity, you represent that you have all necessary authority to purchase shipping labels and use the Shipping Services on behalf of the business or other entity who is the responsible account holder.
  3. Links to Third-Party Websites. The Shipping Services may contain links to third-party websites (“Linked Websites”). Linked Websites are not under the control of PayPal, and PayPal is not responsible for their contents.
  4. No Sublicense or Third-Party Use. You agree to use the Shipping Services only for your own direct use. PayPal does not allow you to sublicense, resell, or offer the Shipping Services to third parties (including customers of yours). If we determine in our discretion, that you have violated the foregoing limitations, we reserve the right to immediately suspend your access to the Shipping Services.
  5. Order Acceptance or Rejection. PayPal reserves the right at any time after receipt of an order for products or services to accept or decline the order for any reason.
  6. Sales and Use or Value Added Taxes. You are responsible for the payment of any sales, use, VAT, or other Taxes owed in connection with your use of the Shipping Services.
    1. For purposes of these Terms, “Taxes” means all federal, state, provincial, territorial, county, municipal, local or foreign taxes, including but not limited to sales, use, license, excise, good and services, value added, digital services, stamp or transfer taxes, duties, imposts, levies, assessments, tariffs, fees, charges or withholdings of any nature whatsoever levied, imposed, assessed or collected by a governmental authority together with all interest, penalties, fines or other additional amounts imposed in respect thereof. “Excluded Taxes” means (i) Taxes based upon gross or net income, (ii) franchise taxes or (iii) property, personal property or rental taxes.
    2. Except as otherwise specified herein, each Party will bear its own Taxes incurred with respect to or resulting from performing under these Terms.
