This page details and/or previews updates to PayPal users of changes to the United Kingdom PayPal User Agreement or other online agreements, policies, or statements that require notice. You can also review Past Policy Updates notices. Note that additional changes could be made to previewed agreements on or before the effective dates listed, provided the applicable notice requirements are met.

We’re making changes to certain agreements (listed below) that govern your relationship with PayPal. These changes will take place automatically on the corresponding effective date(s) shown below.

Actions Needed

Please carefully review the notices below and familiarise yourself with the upcoming changes. By continuing to use our services after the changes take effect, you agree to be bound by those changes. Otherwise, no further action is needed from you to accept such changes. However, if you would prefer to decline them, then you will need to close your PayPal account prior to the applicable effective date, as described in the User Agreement.

Issued: 1 November 2023

Confirmation of Transfer of Services from PayPal (Europe) S.à r.l. et Cie, S.C.A. to PayPal UK Ltd

Further to our previous Policy Update published on 24 July 2023, it is confirmed that PayPal (Europe) S.à r.l. et Cie, S.C.A. is transferring its services provided to users in the UK to its affiliated company, PayPal UK Ltd, on 1 November 2023.

PayPal UK Ltd is authorised and regulated by the Financial Conduct Authority (FCA) as an electronic money institution under the Electronic Money Regulations 2011 for the issuance of electronic money (firm reference number 994790), in relation to its regulated consumer credit activities under the Financial Services and Markets Act 2000 (firm reference number 996405) and for the provision of Cryptocurrency services under the Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017 (firm reference number 1000741). Some of PayPal UK Ltd’s products including PayPal Pay in 3 and PayPal Working Capital are not regulated by the FCA. PayPal UK Ltd’s company number is 14741686 and its registered address is Whittaker House, Whittaker Avenue, Richmond-Upon-Thames, Surrey, United Kingdom, TW9 1EH.

If you are a PayPal Credit customer, you would have received notice of the proposed assignment either as an email, as a secure message or when onboarding. The notice can also be viewed here. With effect from 1 November 2023, PayPal UK Ltd will assume all the rights and obligations of PayPal (Europe) S.à r.l. et Cie, S.C.A. in relation to our UK users, including under the terms of any separate agreement which our merchants may enter into with PayPal unless we have specifically informed these customers in writing otherwise.

Amendments to the PayPal User Agreement
Effective 16 January 2024:

• We are clarifying that fees payable to PayPal do not include taxes and that it is the responsibility of our customers to assess, collect, report and remit taxes to the appropriate authorities. We are also asking our customers to acknowledge that PayPal has an obligation to make reports to tax authorities regarding transactions that we process.
• We are updating the hyperlink on PayPal Fundraisers (Unlisted) in the ‘Standard rate for sending international donations’ on the Consumer Fee Page.
• We are clarifying that we charge no fee for receiving domestic donations for PayPal Fundraisers (Unlisted) and updating the hyperlink for sending international personal transaction rates in the ‘Standard rate for sending international donations’ for PayPal Fundraisers (Unlisted).

Amendments to PayPal’s Seller Protection Program
Effective 16 January 2024:

• We are revising PayPal’s Seller Protection Program to exclude from eligibility:
  • Item Not Received claims filed by buyers as chargeback claims with their card issuers for card-funded transactions.

Amendments to the PayPal Payouts Terms and Conditions

Effective 16 January 2024:

• The PayPal Payouts Terms and Conditions are being updated to clarify existing product functionality, including:
  • Eligibility requirements for recipients of payouts to successfully receive payouts; and
  • Clarifying the respective responsibility of PayPal and senders with regard to payouts made using the PayPal Payouts product
• In addition, the updates provide that:
  • PayPal may require evidence of express recipient consent to receive communications in connection with payouts;
  • Customers must confirm that provision of information to PayPal does not constitute a sale of data to PayPal under applicable law; and
  • Customers may not imply PayPal sponsorship or endorsement without prior permission nor may customers seek to obtain PayPal user credentials.

Changes to PayPal Mobile Application Licence Agreement, PayPal Fundraisers Terms and Conditions and PayPal Digital Gifts Terms and Conditions and actions needed

We have made changes to certain agreements (listed below) that govern your relationship with PayPal. These changes are beneficial to the user and will formally take place on the effective dates shown below. Please carefully review the notices below and familiarise yourself with the changes. By continuing to use these services after the changes formally take effect, you agree to be bound by those changes. Otherwise, no further action is needed from you to accept such changes. However, if you would prefer to decline them, then you will need to stop using the relevant service prior to the applicable formally effective date.

Amendments to the PayPal Mobile Application Licence Agreement

Effective 30 November 2023

• clarifying that you must be 18 or over to accept the terms of the Licence Agreement and use the Application.
• providing clarification on the permitted use of the Application, Licensing Restrictions and Disclaimer of Warranties.
• clarifying our limitation of liability provisions and outlining the terms for compensation payments to be made to us.
• clarifying changes we may make to Licence Agreement and matters arising.
• providing information on automatic updates and functionality with versions of operating system.
• including a support provision to facilitate access to our customer services.

Effective 30 November 2023

• clarifying changes we may make to the Terms and matters arising.
• clarifying provisions relating to suspension or terminating access to the service including introducing an advance notice requirement and opportunity to remedy breach.
• outlining the requirement for your compliance with Privacy and Data Protection legislation.
• clarifying notice provisions where we propose to change the User Interface.
• outlining account and funding requirement for purchases.
• clarifying our liability provision and outlining the terms for compensation to be made to us.
• outlining that we will provide you with notice if we intend to assign our rights under the Terms.
