The Terms and Conditions set forth herein (the “Terms”) apply to you as users of PayPal payment services (the “PayPal Services”) who have agreed to the terms of PayPal’s User Agreement for Personal, Premier or Business Users in Japan (each a “User Agreement”) to open PayPal’s Personal, Premier or Business Accounts in Japan. If you have opened a PayPal Business or Premier Account, you must have also completed your Know-Your-Customer (KYC) verification process pursuant to the Japan Act against Transfer of Criminal Proceeds.
If you are using the PayPal Services to pay for goods or services in order to receive a rebate through the Cashless・Consumer Tax Rebate Campaign (the “Campaign”), it is deemed that you have also agreed to the terms of the User Agreement, the Terms and any other agreements and policies as set forth in the Legal Agreements page of the PayPal Japan website.
If you are using the PayPal Services to pay for goods or services in order to receive a rebate through the Campaign, please read the Terms carefully. In addition, if you are seeking details of the Campaign, please access the following link at URL:https://cashless.go.jp/.
1. Restricted Transactions
1.1 You are restricted from conducting the following transactions (the “Restricted Transactions”):
(1) Making payments for goods or services using another’s cashless payment method in order that you or another person can receive the tax rebate under the Campaign.
(2) Conducting a sale, or initiating a sale of goods directly or indirectly (through another party) and later purchasing such goods at the price initially offered (so as to suggest that a legitimate sale occurred), or any other transaction in which despite objective circumstances indicating otherwise, a sale of goods is completed in order that you or another person can receive the benefit of the tax rebate under the Campaign.
(3) Making a cashless payment when the purpose of such payment is to solely receive the benefit of the tax rebate under the Campaign and not to pay for underlying goods, rights or services.
(4) Treating transactions that are not eligible for the Campaign as if they are in order that you or another person can receive the benefit of the tax rebate under the Campaign.
(5) Despite the transactions under the Campaign being canceled, terminated or being no longer valid for other reasons, or if the transactions relate to cash advance or other transactions that involve cash vouchers and other goods that are outside of the eligible scope of goods allowed under the Campaign, you or another person has received the benefit of the tax rebate under the Campaign.
(6) A merchant who is not eligible to participate in the Campaign under its rules registers as an eligible merchant and provides Campaign tax rebates to consumers.
(7) Any other transactions that are deemed inappropriate in light of the purposes of the Campaign or determined to be “restricted activities” by the Campaign Subsidy Office.
1.2 In the event that PayPal is notified by the Campaign Subsidy Office that an illegal transaction attributable to you has occurred or that an illegal transaction attributable to you is suspected to have occurred, PayPal shall, without prior notice to you, restrict access to your PayPal account or take other measures in order that you will no longer be able to use the PayPal Services. Additionally, you will not be able to receive any tax rebates on alleged illegal transactions.
1.3 In the event that PayPal is notified by the Campaign Subsidy Office that an illegal transaction attributable to you has occurred or that an illegal transaction attributable to you is suspected to have occurred, you acknowledge and agree that all or certain portions of the tax rebates that you received previously may be canceled. In addition, you may also be held liable and be required to indemnify PayPal, the Japanese Government, the Campaign Subsidy Office or any other third parties that are affected by losses arising from such illegal transaction or suspicion.
2. Amendment and Termination
2.1 PayPal may amend the Terms at any time by posting the amended Terms on the website. The amended Terms shall become effective on the date of the posting of such amended Terms.
2.2 Due to changes in social conditions, amendments and abolition of laws and regulations, termination of the Campaign, policies and instructions from the Campaign Subsidy Office, and any other reasons due to PayPal’s business circumstances, PayPal shall reserve its right to amend or terminate some or all of the terms stipulated in the Terms.
2.3 PayPal shall not be liable for any damages and losses (including lost profits or opportunities) arising from the above amendment or termination of the Terms.
3. Definitions
3.1 “Cashless・Consumer Tax Rebate Campaign” (Campaign) means a campaign (https://cashless.go.jp/)led by the Ministry of Economy Trade and Industry as a measure to mitigate decrease in consumer demand due to consumption tax increase.
3.2 “Subsidies for consumer tax rebate” means a process in which PayPal provides to small- to mid-size retailers, service providers and restaurants subsidies equivalent to 5% with respect to each merchant and 2% for merchants that are franchised business, in order that such subsidies are passed through to consumers who use the PayPal Services to make payments.
3.3 “Small- to mid-size retailers” means small- to mid-size retailers who meet the registration requirements for the Campaign.
3.4 “Registration Requirements” means the requirements that apply to the Campaign as set forth in the “Cashless Payment Service Provider Registration Requirements” in the following link(https://cashless.go.jp/assets/doc/kessai_tourokuyouryou_hosoku.pdf)and other laws and regulations that apply to the Campaign, including laws that relate to the appropriate execution of budget for subsidies, etc. (August 28, 1955), rules concerning payment of grants by the Campaign Subsidy Office and application guidelines.
3.5 “Campaign Subsidy Office” means the General Incorporated Association for Promotion of Cashless Payments or the Ministry of Economy Trade and Finance.
3.6 Any other defined terms (other than the above) shall have the meanings attributed to them in the Registration Requirements.
