*Competition Terms and Conditions

  1. This PayPal Working Capital case study competition (“Competition”) is open to businesses that are legal residents of the Australia, that are confirmed registered members of paypal.com.au and that have or have had an open PayPal Working Capital loan as of 10 January 2021. The promoter of the Competition is PayPal Credit Pty Limited ACN 600 629 258 (“PayPal”). The individual who submits the entry on behalf of the business must be aged 18 or over, have authority to do so and must not be an employee or contractor of any PayPal company, its affiliates, subsidiary companies, a representative or agent of those companies, or anyone else who may be professionally involved with the Competition (“Eligible Participants”). PayPal reserves the right to verify the eligibility of participants.

  2. By participating in this Competition you agree to be bound by these terms and conditions (“Terms and Conditions”).

  3. The Competition begins at 00:00:00 AEST on 10 January 2021 and finishes at 23:59:59 AEST on 24 January 2021 (“Competition Period”).

  4. All Eligible Participants are limited to one entry per business throughout the Competition Period. Each of the entries into the Competition will be judged by a panel of expert judges consisting of at least one independent judge. All eligible entries will be judged based on the following criteria:
    1. the impact of the PayPal Working Capital loan on the Eligible Participant’s business – 50%;

    2. clarity of expression (easy to read, clearly written, easily interpreted) – 25%; and

    3. inclusion of PayPal Working Capital features (including funding in minutes, one fixed fee and no credit check or lengthy financial documentation) – 25%.

  5. All Eligible Participants must be deemed credit eligible for a PayPal Working Capital loan, and may not have an outstanding PayPal Working Capital loan that is not in good standing or otherwise behind the anticipated repayment rate by 30 days or more at the time the Prize (as defined below) is awarded. If the Successful Entrant (as defined below) does not meet these requirements, they will be disqualified, and an alternative entry will be determined.

  6. One (1) winner will be selected by the panel after the Competition Period has ended (“Successful Entrant”). The individual winner will receive AUD$1,000 (one thousand Australian dollars), which will be added to the PayPal account balance connected to the Successful Entrant no later than 30 days after the end of the Competition Period.

  7. The contact details provided upon entry to the Competition will be used by PayPal to notify the Successful Entrant or to check the eligibility requirements of participants have been met, and will not be shared with other companies except to the extent necessary to provide the Prize (in accordance with paragraph 22 below). Unsuccessful participants will not be contacted. PayPal will only use your Email Addressand other personal information in compliance with the provisions of Australian privacy legislation.

  8. In providing an entry, a participant acknowledges and agrees that the entry becomes PayPal’s intellectual property and that PayPal may use the entry, in whole or in part, for promotional and marketing purposes without further consideration. Participants authorise PayPal to share their entry, in whole or in part, along with the participant’s first name, last name, business name and business website. PayPal will not share any email, postal address or phone number as part of its promotional or marketing materials.

  9. The Prize is limited to one Prize per entrant. Each Eligible Participant can enter the Competition once, regardless of how many entries they submit. If an Eligible Participant submits multiple entries, then only the last entry submitted by that Eligible Participant will be entered into the Competition. The Prize is not transferable or refundable, and cannot be exchanged for any other product or prize, or cash substitute.

  10. The decisions of PayPal in respect of this Competition are final and no correspondence will be entered into in this respect.

  11. PayPal reserves the right to redraw a Successful Entrant in the event that the original Successful Entrant is disqualified in accordance with these Terms and Conditions, and to withdraw the Prize from the original Successful Entrant in question.

  12. PayPal may ask for proof from the Successful Entrants to verify their personal details (sufficient proof may include a PayPal payment receipt, a credit card receipt or other documentary evidence acceptable to PayPal). PayPal may also ask the Successful Entrant to provide proof of their age and/or country of residence.

  13. Participants will need an Internet connection in order to participate in the Competition. No refund may be claimed for expenses incurred in participating in the Competition, including in relation to the use of the Internet.

  14. If PayPal has suspicions or knowledge that any participant has been involved in any fraudulent or illegal activity, PayPal reserves the right to disqualify that participant and any related participants from the Competition.

  15. PayPal may also disqualify from the Competition any participant that does not act in accordance with these Terms and Conditions or PayPal’s rules and policies.

  16. Entries, lists and or prizes may be withdrawn by PayPal from people using the Competition in a way in which PayPal deems inappropriate at its sole unlimited discretion.

  17. If a participant has a PayPal account, that participant must not be in breach of PayPal’s User Agreement at any time and their PayPal account must be in good standing at all times.

  18. PayPal reserves the right to suspend, change or cancel the Competition at any time as it may determine in its sole discretion without any liability to any participant or any other person. This includes, without limitation, the ability to substitute the Prize with another prize of equivalent or greater value if necessary, or to change the specification of the Prize if circumstances require it, or to change the entry methods, or to change the duration of the Competition Period. PayPal reserves the right to add additional Terms and Conditions for the Prize awarded as a part of this Competition.

  19. PayPal shall not be liable, in contract, in tort (including negligence), for breach of statutory duty or in any other way, for the loss or damage howsoever arising suffered by the entrant resulting directly or indirectly from entry into this Competition. Nothing in these Terms and Conditions shall limit PayPal’s liability for death, personal injury or fraud.

  20. PayPal does not accept, and is not responsible for, any lost or delayed entries. PayPal reminds participants of the nature and limitations of the Internet and is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software that may affect entry to the Competition or receipt of the Prize.

  21. Although PayPal will use reasonable efforts to ensure that all information relating to the Competition (“Competition Material”) is accurate, PayPal is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software failure that may affect PayPal’s operation of the Competition or the PayPal site, including without limitation the accuracy of any Competition Material.

  22. Data Protection.
    1. PayPal may use third parties to facilitate one or more elements of this Competition. It may be necessary to share your personal information with them. These third-party service providers are subject to confidentiality agreements with us and other legal restrictions that prohibit the use of the personal information we provide them for any other purpose except to help facilitate the Competition, for example, to deliver the Prizes.

    2. In providing an entry, a participant acknowledges and agrees that the entry becomes PayPal’s intellectual property and that PayPal may use the entry, in whole or in part, for promotional and marketing purposes without further consideration. Use may include, amongst other things, on our website, in a blog or via email. Participants authorise PayPal to share their entry, in whole or in part, along with the participant’s first name, last name, business name and logo, and business website.

    3. PayPal will not share any email, postal address or phone number as part of its promotional or marketing materials.

  23. Entry into the Competition is conditional on acceptance of these Terms and Conditions, which are governed exclusively by Australian law and under the exclusive jurisdiction of Australian courts. By entering, participants agree to be bound by these Terms and Conditions and the paypal.com.au User Agreement.
